Consultations

The Policy Team submits responses to significant Government and other consultations that the SFHA knows will have an impact on what our members do. The SFHA's Board discusses the content of responses to major consultations. We alert our members to all consultations that we believe will be of interest, indicating which ones we will be responding to. Where a group of members express an interest in a consultation that we had not intended to submit an SFHA response to, we will facilitate a meeting of interested members to assist them in preparing an appropriate response.

Feed in Tariff Consultation

The SFHA has responded to two UK Government consultations on Feed in Tariffs (FiTs). FiTs are revenue payments made to encourage the generation of renewable electricity. The SFHA responded saying that housing associations and co-operatives are ideally placed to lead the development of community based renewable schemes, using their project management expertise and building on their status as trusted organisations in the communities that they serve.

Scotland Bill

The Scotland Bill was introduced in Westminster on 30th November 2010.  The Bill contains the legislative provisions necessary to implement the recommendations of the Calman Commission's Final Report.

People and Communities Fund Consultation Update

The Scottish Government has recently been developing the People and Communities Fund. The Fund is almost ready to be launched and this will take place on Tuesday 8 May. There will be no launch event but the Scottish Government will issue an e-mail to their wider stakeholder groups, update their website and issue a press release.

Their website will be the main source of information for the fund (www.scotland.gov.uk/regeneration) and will include the guidance, application form and help notes from Tuesday 8 May.

The SFHA will keep you updated on the content of the fund: please check our website and the e-newsletter after Tuesday 8 May.

SHR Short Consultation on two technical aspects of the Housing (Scotland) Act 2010

The Scottish Housing Regulator is conducting two short consultations on a couple of technical aspects of the Housing (Scotland) Act 2010.

The two subjects of the consultation are:

  • a draft determination relating to accounting requirements;
  • a proposed determination on what is meant by a step to enforce security over an RSL's land.

Regulation of Social Housing in Scotland

The new independent Scottish Housing Regulator assumed its powers as of 2nd April 2012.

The new SHR has published its new Regulatory Framework and Corporate Plan.  The SFHA has produced a briefing note on the new framework available here: New Regulatory Framework April 2012

Both SHR documents are available on the SHR website, along with a series of guidance notes, here

Guidance produced includes:

The most obvious changes within the Regulatory Framwork from the proposals contained within the original consultation paper are that:

  • The proposal to have a maximum six year term for governing body members has been removed.   Instead governing body members who have had 9 years continuous service will be required to demonstrate to their governing body that they can operate with "objectivitiy" and "independent challenge".
  • Only one performance report on the Charter will be required to be submitted to the Regulator each year- the Annual Return on the Charter (ARC).   This is as opposed to the two reports that had previously been proposed.   However, landlords will still need to produce a separate performance report to tenants on its performance against the Charter, with the format that this takes to be agreed with tenants.

Analysis of Responses

The SFHA has submitted its response to the Scottish Housing Regulator (SHR) consultaiton "the Regulation of Social Housing in Scotland" in November 2011.  This is available on the SFHA website:

The consultation document covers a lot of ground, including:

  • How the SHR will regulate
  • Monitoring the Social Housing Charter
  • Register of Landlords
  • Regulatory Standards of Governance and Financial Management
  • Powers of Inquiry
  • Intervention Powers
  • Consents

This consultation closed on 25th November 2011.

There are many controversial aspects within the document, including proposals to allow governing body members to be paid, and relating to the abolition of Schedule 7 of the Housing (Scotland) Act 2001, leaving it up to the individual organsaition how it manages payments and benefits to staff, governing body members and their close relatives.
